Terms of Service
These Terms of Service (“Terms”) govern your use of Fretuoso websites, iOS applications, and related services provided by Catloaf Software, Inc. (“Catloaf”, “we”, “us”). By using the Service, you agree to these Terms.
1. Eligibility and Acceptance
You must comply with applicable laws when using the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. License and Permitted Use
Subject to these Terms, Catloaf grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use.
You agree not to:
- copy, distribute, or resell the Service except as permitted by law
- reverse engineer or attempt to extract source code except where legally permitted
- interfere with security, integrity, or availability of the Service
- use automated systems to scrape or abuse the Service
3. App Store and Device Terms
Fretuoso is distributed through Apple platforms and may also be subject to Apple’s terms. In case of conflict regarding app distribution or billing mechanics, applicable Apple terms control those topics.
4. In-App Purchases and Billing
Fretuoso may offer optional in-app purchases. Billing, refunds, and payment processing are handled by Apple according to your App Store account terms and applicable law.
- Prices and available products may change over time.
- Access to purchased content may require restoring purchases through your Apple ID.
- We do not store your full payment card details.
5. Subscriptions (If Offered)
If subscription products are offered, renewal, cancellation, and billing are managed by Apple through your account settings. Details shown in the App Store at purchase time govern subscription terms.
6. User Content and Feedback
If you submit feedback, suggestions, or bug reports, you grant Catloaf a non-exclusive, worldwide, royalty-free license to use that feedback to improve products and services.
Do not send unlawful, harmful, or infringing content through support channels.
7. Intellectual Property
The Service, including software, design, text, graphics, and trademarks, is owned by Catloaf Software, Inc. or its licensors and protected by applicable intellectual property laws.
“Fretuoso” is a registered trademark of Catloaf Software, Inc.
8. Privacy
Your use of the Service is also governed by our Privacy Policy.
9. Availability and Changes
We may modify features, content, and functionality over time. We may suspend or discontinue part of the Service when needed for maintenance, security, legal compliance, or product changes.
10. Disclaimers
The Service is provided “as is” and “as available” to the maximum extent permitted by law. Catloaf disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted, error-free operation.
11. Limitation of Liability
To the maximum extent permitted by law, Catloaf and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.
To the extent liability cannot be fully disclaimed, Catloaf’s total liability for claims related to the Service will not exceed the amount you paid for the Service in the 12 months before the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Catloaf from claims, damages, and expenses arising from your misuse of the Service, violation of these Terms, or infringement of third-party rights.
13. Termination
We may suspend or terminate access if you violate these Terms, create legal risk, or abuse the Service. You may stop using the Service at any time.
Sections that by nature should survive termination remain in effect, including intellectual property, disclaimers, limitation of liability, and dispute terms.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.
15. Dispute Resolution
Before filing formal claims, contact us at [email protected] so we can try to resolve the issue informally.
If informal resolution is unsuccessful, disputes will be resolved in courts located in California, unless applicable law requires otherwise.
16. Changes to These Terms
We may update these Terms from time to time. When material changes are made, we will update the effective date and, where required, provide additional notice.
